On December 20, the Delhi High Court’s Justice Nazmi Waziri reserved the order after hearing the petition of Rakesh Asthana and DSP Devendra Kumar. The Court said that prior permission was made without the permission of the Higher Authority before the FIR was filed in this case. At the same time the court told the CBI that in 10 weeks, complete the investigation. The court also lifted the interim stay on the arrest of Rakesh Asthana.
At that time, CBI director Alok Verma had said that all mandatory procedures were followed while registering an FIR in the allegations of bribery against Rakesh Asthana. Businessman Satish Babu Sana had alleged that he had given a bribe to get relief in one case. Sana had charged Asthana with corruption, extortion, arbitrariness and serious misconduct.
In fact, when the war between the then director of Alok Verma and the Special Director Rakesh Asthana, became public and the allegations came out openly, the central government sent the two officers of the CBI to the on-going leave and M Nageshwar Rao appointed an interim director.
Who is Rakesh Asthana:
Rakesh Asthana is the IPS of the 1984 batch Gujarat cadre. He first came to the discussion in 1996, when he arrested Laloo Yadav in the case of fodder scam. On the other hand, in 2002, the SIT formed for investigating the arson at Sabarmati Express in Godhra, Gujarat was also led by Rakesh Asthana. Apart from this, he has been involved in the investigation of several known cases like Ahmedabad Blasts and Asaram Case. CBI has filed an FIR against its Special Director Rakesh Asthana. In this FIR, there is a charge of taking a bribe of Rs 2 crore from Satish Sana, a businessman in the case of meat businessman Moin Qureshi in Asthana. Number two in CBI rank Rakesh Asthana is the head of the SIT created for this investigation. Businessman Satish Sana has alleged that in order to avoid the CBI probe, he took a bribe of about two crore rupees for the next ten months from December 2017.

Asthana told that in August he had informed the Cabinet Secretary about interference in the investigation of 10 cases of corruption, criminal misconduct, sensitive cases of these top officials.
